What Is the Difference Between a Work Permit and a Work Visa?

  • A work visa enables you to live in the U.S. and work exclusively for a specific employer. This employer is responsible for applying for the visa on your behalf, and the visa remains valid as long as you remain employed by that specific employer. Should you leave this employer, you will be unable to work for any other entity until you secure an alternative immigration status.
  • On the other hand, work permits, or Employment Authorization Cards, are not tied to any particular employer. Once you possess a work permit, you have the flexibility to work for any employer within the United States, as long as your immigration status permits employment. You can also renew your permit as needed. Keep track of your work permit’s expiration date to ensure timely renewal. The validity period of work permits varies based on your immigration status. Some individuals may need to renew their work permits annually, while exceptions exist, such as asylum employment authorization cards, which are valid for 540 days (approximately 1.5 years) as of May 2022.

 

Work Authorization and Renewal:

Always monitor the expiration date on the front of your work authorization card to determine when it’s time for renewal. Renewing your work permit in advance is crucial to avoid interruptions in your ability to work in the U.S.

Working Without a Work Permit:

Working in the United States without a work permit or Employment Authorization Card is a risky endeavor. Unauthorized employment may result in deportation, a ban from reentering the U.S. for 3–10 years, and potential difficulties in obtaining temporary or permanent immigration status in the future. Even short-term or “under the table” employment requires a work permit, as working without proper authorization can lead to severe immigration consequences.

In summary, it is essential to refrain from working in the United States without a valid work permit.
